The website along with the mobile site, smartphone application platforms (collectively ‘Booking Platform’) is published and maintained by TFB Travel Tech Private Limited (“Company / TFB”), a company incorporated under the laws of India and having its registered office at 760, 4th flor, 19th Main Road, Sector 2, Garden Layout, HSR Layout, Bengaluru, Karnataka, India - 560102

This Booking Platform is provided solely to assist customers in gathering travel information, determining the availability of travel-related services, making legitimate reservations or otherwise transacting business with travel suppliers and for no other purposes. The term “You” refers to customer, user, traveler, visiting the Booking Platform and/or booking a reservation through us on the Booking Platform, or through our customer service agents.

This Booking Platform is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the “Agreement”). By accessing our using this Booking Platform in any manner, you agree to be bound by the Agreement. Please read the Agreement carefully. If you do not accept all of these terms and conditions, please do not use this Booking Platform.

USE OF THE BOOKING PLATFORM









PROHIBITED ACTIVITIES

The content and information on this Booking Platform (including but not limited to, price and availability of travel services), is proprietary to us or our suppliers and providers. While you may make limited copies of your travel itinerary (and related documents) for travel or services booked through this Booking Platform, you agree not to otherwise modify, copy, distribute, transit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products or services obtained from or through this Booking Platform.

Additionally, you agree not to:

Make any speculative, false or fraudulent reservation or any reservation in anticipation of demand; Access, monitor or copy any content or information of this Booking Platform using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission; Deep-link to any portion of the Booking Platform (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; Violate the restrictions in any robot exclusion headers on this Booking Platform or bypass or circumvent other measures employed to prevent or limit access to this Booking Platform

You understand that any violations of this clause may result in the cancellation of your booking (s)/ reservation, in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such booking / reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.

LIMITED LIABILITY OF TFB

Unless TFB explicitly acts as a reseller in certain scenarios, TFB always acts as a facilitator by connecting You with the respective service providers like airlines, hotels, restaurants, bus operators etc (collectively, the “Service Provider”). TFB’s liability is limited to providing You with a confirmed booking as selected by You.

TFB solely acts as a facilitator to assist customers in gathering the travel information, determining the availability of travel-related products and services, making legitimate reservations or otherwise transacting business with suppliers/ Service Providers for facilitating travel requirements. TFB is not the last-mile service provider.

Any issues or concerns faced by You at the time of availing any such services shall be the sole responsibility of the Service Provider. TFB will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence on the part of any Service Provider.

In no event will TFB be liable to you for any special, indirect, incidental, consequential, punitive or exemplary damages, lost revenue or loss of anticipated profits or any other loss or damage of any reason whatsoever.








By making a booking, You understand that TFB is merely providing a technology platform for booking of services and products and the ultimate liability rests on the respective Service Provider and not TFB. Thus the ultimate contract of service is between You and the Service Provider.

COMMUNICATION POLICY

Upon transacting on the Booking Platform, you will receive an e-mail from TFB informing the status of your booking. The e-mail will be sent to the e-mail address provided by you at the time of booking, and TFB is not responsible for the receipt of the said e-mail in your inbox. You are responsible for entering the proper and accurate contact details, including your name, e-mail id, contact number to ensure that we can effectively communicate with you.

You acknowledge that SMS (Short Messaging Service) provided by TFB is an additional facility provided for customer’s convenience. It is not mandatory under the law in force to provide SMS service alerts to the customers. TFB is not responsible to provide any information on any change in flight schedules, cancellations, status of your booking with the Service Provider.

YOUR RESPONSIBILITY

You are advised to check the description of the services and products carefully before making a booking. You agree to be bound by all the conditions as contained in the booking confirmation or as laid out in the confirmed booking voucher. These conditions are also to be read in consonance with this Agreement. If You intend to make a booking on behalf of another person, it shall be your responsibility to inform such person about the terms of this Agreement, including all rules and restrictions applicable thereto.

The services are provided on an "as is" and "as available" basis. TFB may change the features or functionality of the services being provided at any time, in its sole discretion, without any prior notice. TFB expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, reasonably fit for all purposes. No advice or information, whether oral or written, which you obtain from TFB or through the services opted shall create any warranty not expressly made herein or in the terms and conditions of the services.

SECURITY AND ACCOUNT RELATED INFORMATION

While registering on the Booking Platform, you will have to choose a password to access that User's account and shall be solely responsible for maintaining the confidentiality of both the password and the account as well as for all activities on the account. It is the duty of the User to notify TFB immediately in writing of any unauthorized use of their password or account or any other breach of security. TFB will not be liable for any loss that may be incurred by the User as a result of unauthorized use of the password or account, either with or without the User's knowledge. You shall not use anyone else's account at any time.

You understand that any information that is provided to this Booking Platform may be read or intercepted by others due to any breach of security at the User's end.

TFB processes all the data in relation to credit card, debit card, bank information etc. secured and in an encrypted form in compliance with the applicable laws and regulations. However, for cases of fraud detection, offering bookings on credit (finance) etc., TFB may at times verify certain information of its users as and when required.

TFB adopts the best industry standard to secure the information. In the event of any unforeseeable situation regarding information/ data integrity, the data of the user/customer as available with TFB may be shared with concerned law enforcement agencies for any lawful or investigation purpose without your consent.

FEES AND PAYMENT

In addition to the cost of booking as charged by the Service Providers, TFB reserves the right to charge certain fees in the nature of convenience fees or service fees. TFB further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to you before confirming the booking or collecting the payment.

In cases of short charging of the booking amount, taxes, statutory fee, convenience fee etc., owing to any technical error or other reason, TFB shall reserve the right to deduct, charge or claim the balance amount from you and you shall pay such balance amount to TFB. In cases where the short charge is claimed prior to the utilization of the booking, TFB will be at liberty to cancel such bookings if the amount is not paid before the utilization date.

Any increase in the price charged by TFB on account of change in rate of taxes or imposition of new taxes, levies by Government shall have to be borne by you. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.

You understand that TFB is merely a facilitator of services; therefore, in the rare circumstance of booking not getting confirmed for any reason whatsoever, TFB will deploy reasonable efforts to work with the service provider/ supplier to either provide an alternate booking or to compensate or replace the confirmed booking. This is completely dependent on the discretion of the end supplier. All subsequent bookings will be treated as new transactions any applicable refund will be processed upon the successful receipt of the said refund from the end supplier. All defined policies of TFB and service provider shall continue to remain in effect.

You agree and understand that all payments shall only be made to bank accounts of TFB. TFB or its agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of TFB. If user transfers any amount against any booking or transaction to any bank account that is not legitimately held by TFB or to any personal account of any person, TFB shall not be held liable for the same.



Refunds, if any, on cancelled bookings will always be processed upon successful receipt from the supplier to the respective account or the banking instrument (credit card, wallet etc.) from which payment was made for that booking. Booking(s) made by you through the Booking Portal are subject to the applicable cancellation policy as set out on the booking page or as communicated to the customers in writing.

TRAVEL DOCUMENT

It shall be the sole responsibility of the traveler to ensure that they are in possession of valid travel documents such as identity proof, passport, visa (transit visa) etc. to undertake the travel. You agree that in case of inability to travel for not carrying valid travel documents, TFB shall in no way be held liable. You understand that the information (if any) provided by TFB regarding travel documents is only advisory in nature and cannot be considered conclusive. You shall ensure checking the requirements of travel with the respective Service Provider.

International bookings made through the Booking Platform are subject to the requirements of visa including but not limited to transit visa, OK TO BOARD which are to be obtained by the traveler as per the requirement of their travel bookings and the requirements of the countries the traveler intends to visit or transit through.

TFB is not responsible for any issues, including inability to travel, arising out of such visa requirements and is not liable to refund any amounts for being unable to utilize the booking due to absence or denial of visa, irrespective of whether or not the traveler / user has availed the services of TFB for visa process too. Refund, if any, will be as per the applicable terms of booking and cancellation policy.

FORCE MAJEURE

There can be exceptional circumstances where TFB and / or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, labor unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, any operational and technical issues, route and flight cancellations etc. or any other reason beyond the control of TFB.

If TFB has advance knowledge of any such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to You or refund the booking amount after deducting applicable service charges, if supported and refunded by that respective service operators. You agree that TFB being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. You have to contact the Service Provider directly for any further resolutions and refunds.

You agree that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third party platforms such as payment gateways, banks etc.) or any other similar failures, TFB’s obligation shall be limited refunding the booking amount, if any, received from the customer. Such refund shall completely discharge TFB from all liabilities with respect to that transaction. Additional liabilities, if any, shall be borne by the User.

In no event shall TFB be liable for any direct, indirect, punitive, incidental, special or consequential damages, and any other damages like damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Booking Platform.


Privacy Policy

We understand that making an online transaction of booking involves a great deal of trust on your part. We take this trust very seriously and make it our highest priority to ensure the security and confidentiality of the personal information you provide to us. Please read our privacy policy.

COVID-19 RELATED TERMS AND CONDITIONS

You agree that due to recent outbreak of COVID-19 pandemic, which has been declared as a national disaster by the Government of India, there may be instances, where the end Service Provider either cancels the booking or refuses to provide the services, , by assigning or not assigning any specific reason for such refusal. Refusal of service may be due to the reasons including but not limited to the traveler: exhibiting any symptoms associated with COVID 19. refusing to comply with safety advisories, like wearing protective gear, complying with social distancing norms etc. suffering of any ailment making the User vulnerable to the virus posing a threat to the health and safety of others

In such cases TFB will assume no liability for the refusal of service by the end service provider. You also agree that refund, if any, for such bookings will be processed by TFB subject to receipt of the same from the end service provider.

You further understand that due to the outbreak of COVID-19, the Central Government through its ministries, State Governments and statutory bodies have/may come up with detailed set of guidelines or standard operating procedure (SOP) that a traveller will have to follow in order to undertake the travel.

The traveller agrees to abide with all such guidelines/SOP while undertaking any travel. Failure to abide by such detailed set of guidelines/SOP, may lead to a situation where the service provider or any person authorized by the Central Government, State Government or statutory body may disallow the User to undertake the travel. In such circumstances, TFB will not be held liable for such refusal to travel and refund, if any, shall be strictly as per the terms of the service provider.

You understand that the Central Government, State Governments and various other bodies, may mandate downloading of Arogya Setu App or submitting a self-declaration form prior to entering a transit point like airport, railway station etc. or at the time of checking-in for a flight, into a hotel etc. Accordingly, the traveler must ensure downloading of Arogya Setu App on their smartphones or provide any other alternate such as self-declaration when demanded.

You undertake that all bookings are subject to certain minimum medical wellbeing criteria specified by the Govt. / appropriate authority from time to time. Traveler should have no medical history of the COVID-19 virus 28 days before the date of scheduled travel. In this regard the traveler may be required to furnish a medical proof or health declaration in applicable format.

NOTICE

All communications by you addressed to TFB shall be by e-mail (grievance @tripsforbusiness.com) and can be sent through physical delivery at TFB Travel Tech Private Limited having its address at 760, 4th floor 19th Main Road, Sector 2, Garden Layout, HSR Layout, Bengaluru, Karnataka, India – 560102.

GOVERNING LAW

This Agreement is subject to interpretation as per the laws of India, and the parties shall refer any unresolved disputes to the exclusive jurisdiction of courts at Bengaluru.
